1. Controller, contact, and data protection officer:
The controller within the meaning of data protection law is Baller League GmbH, Kastanienallee 6, 10435 Berlin ("we"). Our data protection officer can be reached at datenschutzbeauftragter@ballerleague.de.
We conduct the BALLER LEAGUE Scouting Combine Event ("BLSC"), where we continue the recruiting process for the BALLER LEAGUE and search for suitable players (male and female) for the BALLER LEAGUE.
2. Data categories, purpose of processing, and legal basis:
2.1 Participant data
We process the data you provided to us with your application, such as your name, address, mobile phone number, email address, photo, clothing size, football club and achievements, and other personal information that you have voluntarily provided to us, so-called participant data.
Data is processed to conduct the BLSC in accordance with our terms and conditions of participation and thus for contractual purposes, Art. 6 (1) (b) GDPR. The contact details you provide will be used to communicate with you.
2.2. Performance Data
We will conduct various tests at the BLSC to help us assess your soccer skills. This data may be displayed in overviews and in the draft stream.
The following will be tested in particular: acceleration, agility, dribbling, vertical jump, long jump, shooting power, shooting accuracy, passing accuracy, and ball control. In addition, the reaction times and defensive ability of goalkeepers will be assessed. All of this information is your performance data.
Only through the tests can we determine which players are best suited for the BALLER LEAGUE. The collection of performance data is therefore also carried out to conduct participation and based on the data contract, i.e., for contractual purposes, Art. 6 (1) (b) GDPR.
2.3. Marketing Data
We would like to use the BLSC to report on this and promote the BALLER LEAGUE. To this end, we, and possibly also sponsors and advertising partners, will create text contributions, photos, audio recordings, and videos, as well as conduct interviews with BLSC participants. We refer to this data as "marketing data" below. It includes, in particular, your name, your likeness, your nickname, your position, your club, your age, the name of your team, the number of goals scored, and all other football-related data, especially the performance data that you disclose to us and/or third parties.
The marketing data will, in turn, be used to comprehensively promote the BALLER LEAGUE in the media (especially the internet, radio, television, and social media) offline and online. Data processing is carried out based on the data contract and therefore for contractual purposes, Art. 6 (1) (b) GDPR.
3. Recipients and categories of recipients:
The performance data will be shown, in particular, to the coach and, if applicable, the team captains to decide on team allocation.
The marketing data, including the performance data, will be shared with sponsors or partners who may also use it. This includes, in particular, Xing (New Work SE) and Prematch Sports GmbH with the app of the same name, both of which are authorized to publish player data.
4. International data transfer:
Personal data will only be transferred to a third country outside the European Union or to an international organization if the data is published in a sufficiently wide medium, such as the Internet, with worldwide access.
5. Storage period and deletion:
If you are eliminated from the BLSC, your fitness data will be deleted no later than six months after the BLSC. Your participant data will remain with us for up to three years after the BLSC. The marketing data can be used for the promotion of the BALLER LEAGUE until further notice. This includes not only this season, but also future seasons.
6. Obligation to provide data:
You are not obligated under applicable law to provide personal data. By confirming the terms and conditions of participation and concluding the data processing agreement, you are obligated to provide your performance and marketing data for the stated purposes, as otherwise the BLSC cannot be carried out properly.
7. Your rights:
Under applicable data protection law, in addition to the right to lodge a complaint with a supervisory authority and the right to withdraw consent at any time without affecting the legality of the processing carried out on the basis of consent, you have the rights set out below under a) - f). a) Right to information
You have the right to request confirmation from us as to whether personal data concerning you is being processed. If this is the case, you have the right to information about this personal data. This right to information includes, in particular, information about the processing purposes, the categories of personal data being processed, and the recipients or categories of recipients to whom the personal data have been or will be disclosed. Please note that this right to information is not an absolute right, and the legitimate interests of other persons may lead to a restriction of this right to information.
b) Right to rectification
You have the right to request the rectification of inaccurate personal data concerning you. Taking into account the purposes of the processing, you also have the right to request the completion of incomplete personal data – also by means of a supplementary declaration.
c) Right to erasure (“right to be forgotten”)
If the relevant conditions are met, you can request that the personal data concerning you be erased immediately.
d) Right to restriction of processing
If the relevant conditions are met, you can request that processing be restricted. In this case, the personal data concerned will be marked accordingly and, if necessary, only processed for specific purposes.
e) Right to data portability
If the relevant conditions are met, you have the right to data portability with regard to the personal data you have provided to us, i.e., the right to receive it in a structured, common, and machine-readable format and, if necessary, to transmit this data to another controller without hindrance from the person to whom the personal data was provided.
f) Right of Objection
Under certain circumstances, you have the right to object to the processing of personal data concerning you for reasons related to your particular situation. This also applies to any related profiling. You also have the right to object to the processing of your personal data for direct marketing purposes at any time and free of charge. The same applies to the processing of personal data, including profiling, insofar as this is related to direct marketing. Please note that the use of data for marketing purposes is absolutely necessary to conduct the BLSC.
